Terms of Service

In short: Be respectful, follow our community rules, don't abuse the platform, and understand that the service is provided as-is by a volunteer-run community. Breaking the rules can get your account suspended.

Acceptance of These Terms

By accessing or using the Section.8 community platform (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These Terms apply alongside our Privacy Policy.

Who Can Use the Service

The Service is intended for users who are 18 years of age or older. By using it, you confirm under penalty of perjury that you meet this age requirement and that you have the legal capacity to enter into these Terms.

You agree to comply with all applicable laws when using the Service, and to comply with the terms of any third-party platforms you choose to use or link (for example, Discord, VRChat, and Patreon).

Your Account

Access to the Service requires an account created through our supported sign-in provider. You are responsible for:

  • Keeping your sign-in credentials and connected accounts secure.
  • All activity that occurs under your account, including content you post and actions you take.
  • Notifying us promptly at [email protected] if you suspect unauthorised access to your account.

You may deactivate your account at any time from your settings page. When you deactivate your account, your personal data will be permanently deleted within 30 days (see our Privacy Policy for details).

Acceptable Use

You agree that you will not:

  • Harass, threaten, impersonate, or abuse other members or staff.
  • Post content that is illegal, sexually explicit involving minors, hateful, or that infringes the rights of others.
  • Upload malware, attempt to circumvent security or moderation systems, or interfere with the normal operation of the Service.
  • Attempt to gain unauthorised access to any account, system, or data.
  • Use the Service to send spam, bulk unsolicited messages, or conduct commercial activity without our written permission.
  • Scrape, harvest, or bulk-extract data from the Service without our written permission.
  • Evade a ban, suspension, or other moderation action by creating alternative accounts.

Additional community rules — including our Code of Conduct and any event-specific policies — apply and are incorporated into these Terms.

Your Content

You retain ownership of any content you submit to the Service (for example, photos you upload to the gallery, comments, suggestions, and ticket messages). By submitting content, you grant Section.8 a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute that content for the purpose of operating and improving the Service.

You represent that you have all rights necessary to grant this licence and that your content does not violate the rights of any third party. We may remove content that breaches these Terms or our community rules at our discretion.

Moderation and Enforcement

Our staff may review, remove, or restrict access to content, and may warn, suspend, or ban accounts that breach these Terms or our community rules. Where appropriate, an appeal process is available through the Service. We do not guarantee that all prohibited content will be detected or removed.

To report content that violates these Terms or applicable law, email us at [email protected]. We will review and respond within a reasonable time.

Termination

You may stop using the Service at any time by deactivating your account. We may suspend or terminate your access immediately, with or without notice, if you breach these Terms, create a risk to other members, or if we are required to do so by law. Sections of these Terms that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and governing law) will survive.

Third-Party Services

The Service may be used alongside third-party platforms you choose to use or link (such as Discord, VRChat, and Patreon). Your use of those platforms is governed by their own terms and privacy policies. We are not responsible for the availability, content, or practices of third-party services.

Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

Section.8 is a volunteer-run community project. We make no guarantees regarding uptime, data preservation beyond the retention periods described in the Privacy Policy, or the continued availability of any feature. We do not guarantee that all prohibited content will be detected or removed.

Limitation of Liability

To the fullest extent permitted by the laws of Germany, Section.8 and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service. Our liability for damages is limited to cases of intent or gross negligence, except for injury to life, body, or health, or where other mandatory liability applies under German law (such as the Product Liability Act). For breach of a material duty under these Terms, our liability is limited to typical, foreseeable damages.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

Indemnification

You agree to indemnify and hold Section.8 and its operators harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your violation of the rights of any third party.

Changes to These Terms

We may update these Terms from time to time. The current version and the date of the most recent revision are shown at the top of this page. For material changes, we will ask you to re-acknowledge the updated Terms on your next sign-in. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. This does not deprive you of any mandatory consumer protection rights under the law of your country of residence.
